Child Support in Illinois
Parents are at liberty to agree on child support amounts and frequency
and establish a legal agreement with the help of an attorney.
If they cannot come to an agreement,
they may seek a judge’s determination.
In Illinois,
child support is enforced by the Illinois Department of Healthcare and Family Services Division of Child Support.
Payments are processed and delivered through a state-based disbursement unit.
Child support payments through the State are not automatic; they must be applied for.
Payments are based on several factors:
- Ability to locate the non-custodial parent
- Establishment of paternity
- Calculations governed by Illinois laws
According to 750 ILCS (Illinois Compiled Statutes) 5/505, the following guidelines are used to determine the minimum support payment amount:
- One child – 20% of net income
- Two children – 28% of net income
- Three children – 32% of net income
- Four children – 40% of net income
- Five children – 45% of net income
- Six or more children – 50% of net income
There are exceptions to these amounts based on the best interests of the child.
